The three-judge bench that delivered the judgement on the impeachment of former Deputy President Rigathi Gachagua had to explain why the judgement turned out to be 286 pages and not 350 as alluded during delivery of the judgement.
Justice Anthony M’rima, Eric Ogola and Freda Mugambi had to answer lawyer Harrison Kinyanjui whose petition on impeachment is yet to be concluded.
Explaining away the the confusion, Justice Ogola said that the judges have different eyesight and preferred mode of typing hence the difference in numbers.
According to the judge, his eyesight prompted him to have a 350 page judgement since he used a bigger font that his colleagues turned out to have 286 pages.
However, Kinyanjui was not satisfied by the judge’s explanation and believes something must have been reducted from the said judgement.
Kinyanjui, whose client is also challenging the ouster of Gachagua and subsequent swearing in of Kithure Kindiki, also told the three-judge bench to recuse themselves from the matter.

This is because the judges had already delivered their judgement in the main petition challenging Gachagua’s removal where they concluded that the ouster was lawful and in line with the constitution.
However, the judges ruled that they have jurisdiction and will hear Kinyanjui’s petition and any remaining petition on the matter.
The judges further noted that the petition(s) will be heard online from thereon since the bench will not be able to convene physical again.
Kinyanjui opposes the move to go virtual since he believes that the judiciary is trying to sabotage him and going online will see him and his client denied the right to fairness and justice.
