DPP withdraws charges against three Kenya Hospital Association directors

The Director of Public Prosecution has withdrawn charges against three former directors of Kenya Hospital Association Limited.

Principal Magistrate Paul Mutai allowed the DPP to withdraw the matter under section 87(a) of the criminal procedure code pending re-evaluation of the matter.

However, defense lawyers led by Senior Counsel James Orengo opposed the application to withdraw the matter under section 87(a).

Orengo lamented the poor handling of the matter stating that they had been in court since morning and were informed of the decision to withdraw the matter.

The lawyers urged the court to terminate the case rather than have it withdrawn under section 87(a).

“The accused persons should not have charges hanging over their heads,” Orengo said.

The suspects, Barcley Mogere Onyambu, Magdalene Koki Muthoka and John Nyiro Mwero had been accused of failing to lodge the company’s financial statements for the year 2024 with the registrar.

It is alleged that the offense was committed on or before 31st December 2024 at the Nairobi Hospital in Nairobi.

Muthoka is also charged with failing to lodge the company’s financial statement for the year 2022 and 2023.
