Former Baringo Central Member of Parliament Sammy Silas Komen Mwita has been charged in Sh 300 million Nairobi West land fraud.
Mwaita is charged alongside Brian Kiptoo Kiplagat who did not appear in court to plead to the charges.
The two are accused of conspiring to make a grant title without authority for Land Reference No. 209/9968 IR. No. 85847 with intent to defraud Rose Njoki King’au a parcel of land known as plot No. “A” Nairobi West, along Mai Mahiu Road, off Lang’ata Road measuring approximately 0.12 hectares each and valued at Sh 150 million.
Mwaita and Kiplagat are also accused of illegally conspiring to make a Grant Title Land Reference No.209/9968 IR. No.85847 with intent to defraud Micugu Wagatharia of a parcel of land known as; Plot No. “B” Nairobi West, Off Lang’ata Road measuring approximate area 0.12 hectares, valued at Sh 150 million.
The former lawmaker is facing a charge making a Certificate of Title Land Reference No.209/9968 IR. No.85847 without authority for Plot numbers; “A” and “B” Nairobi West, in the name of Shaba Trustees Limited, purporting it to be a genuine document processed and issued by Ministry of Lands.
In addition, Mwaita is charged with two counts of abuse of office in regards to the said land.
The above offenses were allegedly committed on 30th March 2001 in Nairobi.
Lastly, the two are accused of giving false information to the police.
Mwaita denied the charges before Senior Principal Magistrate Ben-Mark Ekhubi.
On the other hand, Kiplagat will appear in court on 5th August 2025 to plead to the charges.
He was released on a cash bail of Sh 3 million.
