Two people have been charged with intermeddling with the property pf a deceased person after using his land as security to secure a loan.
Zelipher Muthoni Giathaiga and Stephen Mwaniki Wachira are accused of willfully and unlawfully taking possession of, disposing of, or otherwise intermeddling with the free property of the late Jeliuth Njeri Wachira alias Jerioth Njeri Wachira, to wit, Plot No. 201 which is a subdivision of LR. No. 1487 (f6;1701-1750 inclusive), by executing a loan agreement and using the said deceased’s original land documents as security for a financial loan of Sh 1,100,000 from Maria Wangu Mutahi without a Grant of representation or express authority under the law.
The duo is alleged to have committed the offense on 14th June 2021 at C.K. Nyoro & Company Advocates offices in Nairobi County.
In another count, theby accused persons are charged with intermeddling with the said property by executing an addendum to the initial illegal loan agreement to secure secondary financing using the said deceased’s original land documents as security for an additional financial loan of 160,000 from Maria Wangui Mutahi without a grant of representation or express authority under the law.
This offense was allegedly committed on 13th January 2022 at C.K. Nyoro & Company Advocates offices in Nairobi.
The two denied the charges before Principal Magistrate Paul Mutai and were released on a cash bail of Sh 200,000 each.
