Former Merishaw School Principal David Gideon Kariuki is now a free man after the court allowed an application by the Director of Public Prosecution (DPP) to withdraw exam malpractice charges charges against him.
The DPP had initially made an application to be given more time to review the charges against him and one Alex Kataiyo Kasaine, an employee at the school.
When the matter came up for mention on 30th June 2026, the prosecution told the court that they wished to withdraw the charges against the two.
Principal Magistrate Daisy Mutai allowed the application to have the charges withdrawn under Section 87(a).
“I will therefore, allow the application to have the charges withdrawn under Section 87(a) of the Criminal Procedure Code,” the magistrate ruled.
The charge sheet drafted by the DPP during their court appearance indicated that the two were to be charged with unlawfully disclosing to the candidates examination material to wit English Paper 1 (101/1) Functional Writing Skills during the conduct of the said examination.
Kariuki also the former Principal at Alliance Boys High School and Kataiyo, the in-charge operator, G-MAX hall at Merishaw, are alleged to have committed the offense on 3rd November 2025 at Merishaw School in Isinya,Kajiado County, with others not before court, being persons charged with the administration and supervision of the 2025 Kenya Certificate of Secondary Education Examination (KCSE).
The duo was also to be charged with conspiracy to facilitate examination malpractice during the administration of the KCSE examination by interfering with the CCTV surveillance system intentional in aiding projections.
